Judicial Council: CARE Act Judicial Council Process Overview Training for Counsel

The CARE Act authorizes specified adult persons to petition a civil court to create a voluntary CARE agreement or a court-ordered CARE plan that can include treatment, housing support, and other services for persons with untreated schizophrenia or other psychotic disorders. This session provides an in-depth overview of the Community Assistance, Recovery, and Empowerment (CARE) Act judicial process and highlights the 11 new rules and 13 new forms created by the Judicial Council for counsel, including public defenders, qualified legal services projects, and county counsel.

Learning Objectives

At the end of the session, participants will have an increased ability to:

  • Describe the overall judicial process and role of the court within the CARE Act.
  • Identify the eleven new rules and thirteen new forms created by the Judicial Council for the CARE Act process.
  • Demonstrate familiarity with CARE Act eligibility, appointment and role of counsel in CARE Act
  • proceedings, and CARE Act’s accountability procedures.

This training is intended for all counsel who will be involved in CARE Act proceeding including public defenders, qualified legal services projects, and county counsel.

This training qualifies for 1 hour of MCLE credit.
